Port City Associates Group Corporation, et al., Case No. 1:25-cv-00321 (W.D. Mich.), the United States District Court for the Western District of Michigan entered judgment in favor of Plaintiff Loren Jane Owens, marking an important step forward for individuals asserting their rights under the Telephone Consumer Protection Act (TCPA).
The Court entered judgment totaling $12,000 across multiple defendants, including Port City Associates Group Corporation, City2Shore Real Estate, Inc., Shelley Frody, Steve Frody, and Kellen Keck. The judgment followed the defendants’ Rule 68 Offers of Judgment, which the plaintiff accepted.
It must be noted that because this judgement was entered on the Defendants Rule 68 offer, it states: “This judgment is not an admission that defendants, Port City Associates Group Corporation, City2shore Real Estate, Inc., Shelley Frody, Steve Frody, Kellen Keck, are liable in this action, or that plaintiff, Loren Jane Owens, has suffered any damage” CLERKS NOTICE OF JUDGEMNT ECF 52.
